Terms & Conditions
4 Seasons Design Ltd’s (4SD) Terms and Conditions for the sale of ex-display and ex-stock items.
1.1 General Terms
All goods will be supplied directly by 4SD and not via a third-party. The items are either ex-display or second hand so there may be signs of wear and tear. It is the Purchaser’s responsibility to ensure they are happy with the condition before committing to purchase.All electrical appliances will come with a current PAT test certification. All electrical appliances will come with a 1-year warranty. All other items will not have a warranty unless otherwise stated. The Purchaser has the right to cancel the order within 14 days of receipt under the Consumer Contracts Regulations 2013. Cancellation must be received in writing with proof of delivery. The Purchaser must return the Goods within 14 days of the notice and be responsible for the costs of return.
1.2 Price and Payment
A 10% deposit of the total price of the Goods must be made to 4SD to secure the sale of the Goods. The Deposit is non-refundable. Full payment for the Goods must be received by 4SD no later than 3 days before delivery of Goods. Payment may be made by card transaction or cash payment at the time of collection by the Purchaser. 4SD reserve the right to alter the price of the Goods at any time prior to payment of the deposit of the Goods. Without liability, 4SD may at any time prior to collection of the Goods withdraw the sale.
4 Seasons Design Ltd’s (4SD) Terms and Conditions for purchasers of third-party used kitchens or kitchen equipment.
1.1 General Terms
4SD advertises the sale of kitchens and or kitchen equipment on their website on behalf of a third-party vendor. The sale of the Goods will be in accordance with these Terms and Conditions of Sale. 4SD will provide such details and information of the Goods as communicated to them by the Vendor to give an overview of the type, quality, and condition of the Goods. However, 4SD cannot warrant the accuracy of this information. 4SD do not approve the condition of the Goods but will oorganize a viewing of the Goods when the Purchaser’s winning bid has been authorised by the Vendor. It is then the Purchaser’s responsibility to ensure they are happy with the condition before committing to purchase. Kitchens must be viewed, and the purchase confirmed by the Purchaser, within seven days of their offer being accepted by the Vendor. 4SD will co-ordinate the collection of the Goods between the Purchaser and Vendor.
1.2 The Purchaser’s Duties
The Purchaser agrees that: It is legally able to enter into this contract and is eighteen years and over of age. It will inspect the Goods prior to collection to confirm the condition, completeness and working order of the Goods and highlight any discrepancies against the sale information so that these can be resolved with the Vendor prior to completion of the Purchase. The Purchaser`s contact information can be passed to the Vendor by 4SD. The Purchaser is responsible for organising collection of the Goods and will collect the Goods at the time agreed at the point of sale and that non-compliance with these requirements shall entitle 4SD to cancel the sales agreement on behalf of the Vendor and recover expenses or losses incurred. The Purchaser must check the condition of the Goods again at point of collection and notify any defects immediately. The purchaser takes ownership for the goods at the point that they leave the Vendor’s property. The risk of damage to the Goods during transit is the responsibility of the Purchaser. Should the purchaser choose for the items to be delivered to a storage facility, it is the responsibility of the purchaser to inspect the goods and report any defects within 24 hours of the items being delivered to the storage facility.
1.3 Price and Payment

If payment is not made on the specified dates, 4SD acting on behalf of the Vendor, are entitled to terminate this contract and retain the Deposit. 4SD may alter the price of the Goods at any time prior to payment of the deposit of the Goods. Without liability, 4SD may at any time prior to collection of the Goods withdraw the sale.

1.1 General Terms
4SD agree to photograph and measure the Vendor’s kitchen and list it on their Used Kitchens page of their website for a set ‘Listing Fee’ of £200 + VAT (£240 inc.VAT) 4SD will suggest a guide starting price for the Vendor’s Goods based on the size, age, condition, demand, time until dismantle and original purchase price (if known) but the Vendor can ultimately stipulate their ‘Bids Starting From’ price. 4SD will co-ordinate the collection of the Goods between the Vendor and the Purchaser. 4SD will obtain the payment from the Purchaser and then pay this forward to the Vendor 4SD offer a Removal Service at an additional fee of £400 + VAT (£480 inc. VAT). Please see Removal Service Terms and Conditions.
1.2 The Vendor’s Duties
The Vendor is responsible for providing an accurate overview of the type, quality and condition of the Goods prior to being listed by 4SD. The Vendor’s used kitchen will require cleaning before collection by the Purchaser. It is the Vendor’s responsibility to remove the kitchen unless they would like to use 4SD’s Removal Service. The Vendor must allow the Purchaser to come and inspect the Goods prior to collection to confirm the condition, completeness and working order of the Goods. This should be within seven days of the Vendor accepting the Purchaser’s offer. Any discrepancies highlighted against the sale information raised by the Purchaser must be resolved with the Vendor prior to completion of the Purchase.
1.3 Price and Payment
The ‘Listing Fee’ must be paid in full prior to the listing going live on 4SD’s website. If the sale of Goods is completed, The Vendor agrees to pay 4SD 20% of the final sales prices (our minimum fee is £500). Working on a no sale, no fee basis. The 20% fee shall be deducted from the Purchaser’s payment before being paid onwards to the Vendor. Without liability, 4SD may at any time prior to collection of the Goods withdraw the sale.
Default and Limitation
All guarantees, warranties and associated remedies stated in this agreement are exclusive. No other guarantees or warranty, whether written, oral or implied or inferred from any course of dealing or usage or trade shall apply. Except as expressly and specifically provided in this agreement, all guarantees warranties and other terms implied by statute and or common law are, to the fullest extent permitted by applicable law, excluded from this agreement (including those of merchantable, satisfactory quality, fitness for a particular purpose). Except for any liabilities which cannot be excluded by law, despite any contrary provision of this agreement 4Seasons Design Ltd.’s maximum aggregate liability arising under this agreement whether in contract, tort (including negligence) or any other statutory liability shall not exceed 10% of the website or reserve price for the Goods whichever is the greater. 4Seasons Design Ltd. shall not be liable for any loss of income, profits, goodwill, data, contracts, loss of use or production, loss of bargain or for any indirect and/ or consequential loss or damage in contract, tort or otherwise.
The Contract shall be governed by English law. Where the Purchaser is a Consumer, these terms shall not affect the consumers statutory rights.
4 Seasons Design Ltd’s (4SD) Terms and Conditions for for Removal Service
4SD or its specialist team will provide Services for the safe removal of the Vendors’ kitchens exclusively and does not include delivery to the Purchaser. 4SD’s Removal Service is a standard fee of £400 + VAT (£480 inc. VAT).
Undertake the provision of Services with reasonable skill and care as per the Contract.
4SD has clear, safe and uninterrupted access to the property and the area where the Services are to be performed. The area where the Services are to be carried out is clean, level, has adequate lighting and is clear of debris. The Vendor will notify 4SD of any changes which affect the provision of the Services and any changes may incur an additional charge which will be agreed prior to undertaking the Services. If during the provision of the Services, you agree with 4SD to deviate from the agreed Services, we shall not be liable for any costs, damage or loss arising from such deviation. On completion of the Services, you will be asked to sign a certificate of completion and allow 4SD to take photographs of the completed works. If you are not happy in any way with the Services which have been carried out and you do not note this on the certificate of completion then we will accept no liability if, in the future, you make a claim to us for damage or loss occurred during or as a result of the Services. If you raise a claim or issue in respect of the Services you will allow us access to review the Services and to take photographs of the Services and any alleged damage or poor quality of work.
The cost for the Services shall be due 14 days prior to the provision of Services. Additional charges will become due for payment 14 days following receipt of an Invoice.
Rescheduling of Services
4SD may at any time reschedule the provision of the Services due to factors beyond its reasonable control.
